Very useful information Mack - it is exactly what happened to my dad not long ago for a property he sold some time ago as at the time the builder showed the value on TAPU much less than what he paid :( Luckily he did sorted out eventually but it took him weeks and a lot of communication backwards and forward with the builder and the tax office before he could prove what he really did pay for the property.

I've heard some rumours that there is a new law that virtually eliminates the military clearance requirement for foreign buyers, can anyone "in the biz" confirm or deny this?

That's the major problem that enables most of the scams surrounding foreign property purchases and would be fantastic if it could be done as it is for Turks and conclude a purchase in a few days instead of a few years!

Has anyone heard when the TAPU offices are likely to reopen to re-start processing TAPUs for foreign buyers, its been a while now since they closed, not sure when they'll open again and if the military clearance is still on the table or not, anyone heard anything?

Indeed Mack,

It will be quicker to buy/sell to 'boost' the real estate market.
But at the moment, it is rather the contrary :applaud
We are selling a house in Kemer and of course, they suspend all sales at the worst period of the year.
I will call the tapu offices tomorrow morning.

Just an update to bring the thread up to date a little.

Military clearance is now scrapped, or not exactly scrapped, there is still a search and map permissions given but instead of having it all sent off to Izmir and waiting for months and years its all done in the local TAPU offices now so, in theory, clearance can be granted in a matter of days or weeks maximum.

While this helps it still doesn't eradicate the previously mention scams so still be aware but its a good step forward, one that many have been waiting for over a decade for but better late than never, hope they can move on to plugging other loopholes now.

A small clarification, Military clearance on property purchase hasn't been completely scrapped!

Previously, for foreigners, all property title deeds needed to get a special permission from the Military Headquarters in İzmir to check location of the property; how close it is to military zones, strategic facilites or military units etc.

From now on, according to the new declaration, if a foreign buyer has already received Military permission regarding a parcel of land or property after 05/05/2011, any subsequent buyers do not need to ask again for permission. This includes if any other foreigner has applied on your sitesi.
That means foreign buyers do not need to get Military permission from Izmir again.
